Public offer (comprehensive terms)

This document published at https://kamchatniy.com constitutes a public offer by OOO Kamchatny and Partners (KAMCHATNIY I PARTNERY LLC) — the «Contractor», registration data as in the Russian version — to any user («Customer») who accepts the offer in the ways set out below. By placing an order, making a payment, registering an account where consent is required, or signing separate terms, the Customer accepts this offer together with product/course/shop terms and, where applicable, the license/offer for educational products and personal data consent.

1. Scope of services and goods

The Contractor provides IT and consulting; online education, courses, academy access; e-commerce of digital and other goods, software licenses, personal account and related support — as published on the Site, subject to the selected tariff, product page and, where applicable, individual agreements, bills and specifications. Consumer protection rules of the Russian Federation apply where the Customer is a consumer within the meaning of the Russian Consumer Protection Act.

2. Acceptance, formation of the contract, payment

The contract is generally deemed formed upon successful (or, if expressly allowed, partial or scheduled) payment confirmation by the payment provider, unless a separate document sets another moment. The Contractor uses third-party acquiring; the Customer’s relations with the bank and fees follow bank rules. Electronic invoices and tax documents are issued in accordance with applicable Russian law.

3. Intellectual property and restrictions

The Customer receives a non‑exclusive, non‑sublicensable, personal (unless a corporate/team licence is purchased) right to use digital content for which access was paid, during the access period, without circumvention of DRM or reverse engineering except where permitted by law. Redistribution, resale, public re‑transmission, mass copying or use that exceeds the purchased rights is prohibited. Breach may result in termination of access without pro‑rated refund, subject to a reasonable notice where feasible.

4. Personal data

The Contractor processes data necessary to perform the contract, comply with 54-FZ, tax law, 152-FZ and security requirements. A separate consent may be required at the consent page. The Customer may request access, rectification, deletion or limitation by contacting clients@kamchatniy.com.

5. Liability, refunds, dispute resolution

The Contractor is liable to the customer within the scope of the Civil Code and consumer law as applicable, excluding indirect damages, lost profits and consequential damages, except in cases of intent or gross negligence, or mandatory statutory minima. Refund cases follow consumer law, product descriptions and, for digital services, the rules stated at checkout. Disputes: first a written (email) claim, then courts at the Contractor’s place of registration or the customer’s domicile per Russian jurisdictional imperative rules for consumer disputes.

6. Changes, governing law, contacts

The Contractor may change this public offer: material changes to paid ongoing services are communicated; continued use of new one‑off orders after the date of publication in the revised text constitutes acceptance to new orders.
